Terms and Conditions

 

Participants agree to be bound by these terms and conditions (the ‘Terms and Conditions’).

Any information or instructions published by the Promoter about the Promotion at

www.samsung.com/uk/offer/tradeup form part of these Terms and Conditions.

The Promoter

  1. The Promoter is Samsung Electronics (UK) Limited, Samsung House, 1000 Hillswood Drive,

Chertsey, Surrey, KT16 0PS (the ‘Promoter’ or ‘Samsung’). Claims must not be sent to this address

as they will not be processed.

Promotion Period

  1. The Promotion will commence at 00:01 (GMT) on 21st May 2015 and shall close at 23:59 (GMT)

on 12th August 2015 (the “Promotion Period”).

Eligibility

  1. To be eligible to participate in the Promotion you must be a UK or Republic of Ireland resident

aged 18 years or over.

  1. This Promotion is available only to consumers (i.e. not to any business or reseller).
  2. Employees or agents of the Promoter, stockists, retailers and resellers are not eligible to enter.

Off er

  1. Participants who purchase a new (i.e. not second hand or refurbished) qualifying Samsung

product from the list of models set out in the table below paragraph 7 (each a “Promotion Product”

and together the “Promotion Products”) within the Promotion Period from a Participating Retailer

in the UK or Republic of Ireland will be entitled to Trade Up a TV meeting the criteria set out in

paragraph 9 and receive a “Trade Up Reward” for the relevant amount applicable for the Promotion

Product purchased.

  1. Purchases from auction websites (e.g. eBay), marketplace sales through retail websites (e.g.,

E-Buyer, Amazon Marketplace or Play Trade) or sales from Costco, Electro Centre, Brighthouse

are specifi cally excluded from this Promotion. The Promotion Product must not be sold as part of

another promotion (save for promotions off ered directly by the Participating Retailers).

  1. Participants must take the TV they wish to Trade Up to a Participating Retailer store at the

same time as they make the new purchase; For instore or online purchases please liaise with

participating retailers for conditions relating to returning your Trade Up TV.

  1. For the Trade Up television to qualify for the Trade Up Reward it must be a fl at panel TV with a

diagonal screen size of 32 inches or more: the “Trade Up Criteria”.

  1. A maximum of one reward per qualifying Promotion Product purchased.

Claims

  1. In order to participate in the Promotion and claim a Trade Up Reward, participants must go

to www.samsung.com/uk/off er/tradeup and follow the prompts to the redemption page where

they will be asked to complete the online claim form, submit a copy of their proof of purchase and

confi rm details of their returned TV including screen size, brand and model (the ‘Claim’).

  1. Participants must wait 30 days after purchase before submitting a claim. Claims must be

made within 60 days of the date of purchase (the “Claim Period”) meaning the fi nal claim date for

purchases made on 12 August 2015 is no later than 23:59 (GMT) on 10th October 2015 (the “End

Date”). For the avoidance of doubt, the date of purchase on the invoice or receipt counts as day 1

of the Claim Period. Claims received outside the Claim Period will be marked as invalid and will not

be accepted.

  1. Provided the application is approved, participants will receive a confi rmation email within 2

days.

  1. Provided that the returned TV meets the Trade Up Criteria the participant will receive

confi rmation of receipt by email and SMS stating that the Claim has been successful and has been

validated and that the Trade Up Reward will be paid via a bank transfer within 30 calendar days.

If an email acknowledgement has not been received within 2 calendar days of the participant

making a Claim, or if the bank transfer for the Trade Up Reward has not been received within 30

calendar days of the email acknowledgment, it is the claimant’s responsibility to contact the

Promoter’s customer service team at help@SamsungTradeIn.com or by telephone on 0843 5962

981.

  1. Only invoices and receipts will be accepted as proof of purchase. The purchase price of the

Promotion Product purchased must be clearly indicated as paid. If a participant fails to provide a

valid proof of purchase and/or the Claim has not been submitted correctly, the participant will be

notifi ed via email and SMS and off ered the opportunity to provide the required information within

7 days. If no response is received, one further email and SMS will be sent requesting the required

items. If no response is received within 7 days of the second email and SMS, then the Claim shall

be marked as invalid and the Participant will no longer be eligible to participate.

  1. Claims that are incomplete or damaged will be deemed invalid. No responsibility is accepted by

the Promoter for lost, delayed or damaged Claims (e.g. which are lost in the post or where online

data is not received or is corrupted).

  1. The Promoter reserves the right at its absolute discretion to disqualify Claims which it

considers do not comply with these terms and conditions.

  1. The Promoter shall have the right, where necessary, to undertake all such action as is

reasonable to protect itself against fraudulent or invalid claims including, without limitation, to

require further verifi cation as to proof of purchase, as well as the identity, age, and other relevant

details of a participant.

  1. If a participant returns the Promotion Product after submitting a Claim, the Claim will be invalid

and the participant must immediately call 0843 5962 981 to cancel the claim. The Promoter

reserves the right to check with the retailer whether a Promotion Product has been returned and,

by submitting a Claim, the participant provides consent to the Promoter to do so. The Promoter

reserves the right to report suspicious activity or Claims to the police.

  1. A Claim must be made by the participant and must not be made through agents or third

parties.

  1. The name and address shown on the proof of purchase must match the participant’s details

included on the claim form.

Privacy and Data Protection

  1. The Promoter may use any personal information submitted by the participant to advise

participants of future promotions and to provide information about products of the Promoter

or its associated companies that may be of interest. The participant hereby consents to such

personal information being used for this purpose and confi rms that it agrees with the Promoter’s

privacy policy available at: www.samsung.com/uk/info/privacy.html. The participant may withdraw

consent to such use of personal information by writing to the Promoter or by using the opt-out

process outlined in the Promoter’s privacy policy.

  1. Other than as set out in these terms and conditions or for the purposes of operating the

Promotion, the details and information provided by the participant when entering the Promotion

or claiming the Trade Up Reward will not be used for any promotional purpose, nor shall they be

passed to any third party.

General

  1. The Promoter shall not be liable for any interruption to the Promotion whether due to force

majeure or other factors beyond the Promoter’s control.

  1. The Promoter reserves the right, acting reasonably and in accordance with all relevant

legislation and codes of practice, to vary the Terms and Conditions of the Promotion.

  1. The Promoter will not be responsible or liable for: (a) any failure to receive submissions due

to transmission failures and other conditions beyond its reasonable control; (b) any late, lost,

misrouted, or damaged transmissions or claims; (c) any computer or communications related

malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the

control of the Promoter; or (e) any printing or typographical errors in any materials associated with

the Promotion.

  1. Participants will be solely responsible for any and all applicable taxes and any other relevant

costs or expenses which are not stated in the Terms and Conditions as included in this Promotion.

  1. By participating in this Promotion, you agree, to the maximum extent permitted by applicable

laws, to release and hold the Promoter harmless from any and all liability whatsoever for any

injuries, losses or damages of any kind arising from participation in or in connection with the

Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or

misuse of the Trade Up Reward. The above limitation of liability shall not apply to death or personal

injury caused as a result of Promoter’s negligence.

The Promotion is governed by English law.
